1. Introduction
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) govern the online sale of products offered on the website www.marypup.eu (“the Site”), operated by Mélanie Iudica, registered with the B.C.E. under number 0896.755.397, conducting business under the name “Marypup,” with headquarters located at Rue de l'Orphelinat 59/103, 1070 Anderlecht, BELGIUM.
Throughout the site, the terms "we" and "our" refer to Marypup. Individuals wishing to purchase Marypup products are referred to in these Terms and Conditions as “the Client” or “you.”
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions of Sale (GTC), including the legal notices and policies referenced herein and/or available via hyperlink.
These terms and conditions apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or content contributors.
Please read these terms and conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions of Sale. If you do not agree to all the terms and conditions of this agreement, you may not access the website. If these GTC are considered an offer, acceptance is expressly limited to these GTC.
Any new features or tools added to the current store will also be subject to the Terms and Conditions of Sale. You can review the most current version of the GTC at any time on this page. We reserve the right to update, modify, or replace any part of these GTC by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2. Scope
These General Terms and Conditions of Sale govern the rights and obligations of the Parties arising from the online sale of Products offered on the Site. These GTC apply to all products sold via the site and take precedence over any other general conditions from Marypup or the Client. They cannot be modified without the prior, express, written consent of Marypup.
The Products available for purchase on the Site are intended exclusively for individual Clients residing in one of the following countries: Germany, Austria, Belgium, Cyprus, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, Portugal, Slovakia, Slovenia, Spain, and the United Kingdom.
Marypup provides all its services from Belgium, and the contract between the Parties shall be deemed executed in Belgium, with deliveries to various countries.
We are not responsible if the information made available on this site is not accurate, complete, or current. The content on this site is provided for informational purposes only. Any reliance on the content of this site is at your own risk.
This site may contain certain historical information. Historical information, by nature, is not current and is provided for reference only. We reserve the right to modify the content of this site at any time, but we are not obligated to update the information on our site. You agree that it is your responsibility to monitor changes to our site.
3. Legal Capacity and Acceptance
By agreeing to these terms of use, you represent that you are at least of the age of majority in your country of residence, or that you are of the age of majority in your country of residence and have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the site, violate any laws in your jurisdiction (including, but not limited to, copyright laws).
You must not transmit any viruses or any code of a destructive nature. A violation or breach of any of the Terms will result in immediate termination of your Services.
We reserve the right to refuse service to anyone for any reason at any time.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
4. Products
Some products may be available exclusively online on the site. These products may have limited quantities and can only be returned or exchanged in accordance with our Returns and Refund Policy.
The products offered by Marypup are those displayed on the Site at the time the Client completes their order. Products are subject to availability.
We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products we offer. All product descriptions or product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.
Marypup has made every effort to display as accurately as possible the descriptions, colors, and images of the Products that appear on the Site. Occasionally, there may be information on our site or within the Service that contains typographical errors, inaccuracies, or omissions related to product descriptions, prices, promotions, offers, shipping charges, delivery times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any associated website is inaccurate at any time without prior notice (including after you have submitted your order).
The photographs on the site are non-contractual. Limitations in color reproduction and the individual color settings of your screen may cause slight variations. Therefore, Marypup cannot accept any responsibility for any errors that may appear in the Product descriptions or photographs, including slight color and dimension variations.
5. Pricing and Billing
The prices are those indicated on the Site at the time the Client places their order. Prices may vary because they are intended for different countries and are subject to different rules, including VAT regulations. The prices applicable to the Client are those indicated on the Site for the destination country from which the Client places their order. Clients must place orders from the country in which they normally reside. Orders cannot be placed in one country for delivery in another.
Due to circumstances beyond our control, prices may need to be adjusted up or down, including any changes to the VAT rate. If, for this or any other reason, an item is unacceptable, it may be returned in accordance with our Returns and Refund Policy.
The prices indicated during the purchase process are expressed in euros and include VAT and administrative fees unless otherwise expressly indicated.
Product and service prices do not include shipping fees; these will be charged separately and must be paid by the Client in addition to the purchase price. Any discount granted to the client will be deducted from the price separately.
Marypup reserves the right to change sale prices and shipping charges at any time; however, Products purchased and charges will always be billed at the prices indicated in the order confirmation email. These are the prices in effect at the time of purchase, provided the Products are available. Marypup will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
The Client agrees that Marypup will send invoices electronically; however, if the Client wishes to receive a paper invoice, they may simply request one by email at info@marypup.eu.
Products will remain the property of Marypup until the Client pays the full purchase price and shipping fees.
6. Payment Methods
Purchases can only be paid for on the Site. Purchases may be paid through PayPal or one of the credit or debit cards listed on the PayPal payment page. The Client's bank account will be charged once the purchase is confirmed, and payment will only be effective when the Client's bank has approved the transaction with Marypup. If the Client's bank refuses payment, the order will be automatically declined.
The Client guarantees that they are authorized to make payments by one of the payment methods listed above and that there are sufficient funds in the bank account linked to the credit card to cover all costs arising from the transaction. Otherwise, Marypup may refuse the order.
Marypup uses PayPal to manage online payments. Marypup does not have access to or retain confidential payment information from its clients.
Marypup reserves the right to refuse any order from a Client with whom it has an ongoing dispute or who has previously raised a dispute. Marypup may also refuse an order if the Client has not paid a previous order, in full or in part.
7. Ordering Products
Notwithstanding any written proof the Client may have, it is expressly agreed that the data recorded in Marypup’s systems, those of its hosting partners, or its Internet payment partners shall constitute the sole proof of communications, order content, and all transactions that have taken place between the Parties.
To place an order, the Client visits the “E-Shop” section of the Site, selects the item they wish to purchase, and clicks on the icon below the Product they wish to buy. This places the selected item in the “Cart” and will take the Client to the secure PayPal site. The Client can modify their order as long as the products are in the cart. The total amount to be paid is clearly indicated throughout this page. Once the payment process is complete, the order is final and cannot be modified.
The Client will receive an email confirming their order once the purchase has been made. Validation of an order form is equivalent to an electronic signature that has the same value between the Parties as a written signature and serves as proof that the order is complete and correct and that the amounts due can be claimed in the execution of that order.
We reserve the right to refuse any order you place with us. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order.
8. Deliveries
Marypup is committed to making every effort to deliver all orders. However, Marypup cannot be held responsible for product unavailability or any resulting losses. If one or more items in an order are unavailable, Marypup will inform the Client by email or in writing, notifying them that their order has been canceled in whole or in part or split into multiple shipments.
If any Products are unavailable and the Client has been informed but has already paid for the Products, Marypup will request an immediate refund from their bank for the amount paid for the unavailable items and will notify the Client by email accordingly. The speed at which the refund is processed depends on the payment method chosen by the Client at the time of purchase.
In any case, Marypup will complete the refund within 14 days.
The ordered products will be delivered to the delivery address provided by the Client during the ordering process, subject to the general conditions described therein.
When validating their order, the Client may choose delivery to a specified address (home, workplace, or other). Orders can only be delivered to addresses located in the following countries: Austria, Belgium, Cyprus, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, Portugal, Slovakia, Slovenia, Spain, United Kingdom.
Marypup will make every effort to ensure the order is shipped to this address within 5 days of the order payment.

9. Right of Revocation and Returns
The Client may exercise their right to revoke an order by copying the “Order Cancellation Form” found on the Site, completing it, and sending it to Marypup via one of the following methods:

The Client must do this within 14 calendar days of receiving the Product, without being required to pay any damages or provide a reason. Marypup will confirm receipt of the order cancellation form to the Client by email or postal mail.
Customized products or those made according to the Client’s explicit requirements are excluded from the right of revocation. Gift cards are neither refundable nor exchangeable.
The right of withdrawal for delivered Products only applies if the Product is also returned within 14 calendar days following the Client’s notification to Marypup of their intention to revoke the purchase.
The revoked Product must be returned as new in its original packaging, in perfect condition (clothing must not have been worn), and accompanied by the original sales invoice (of which the Client retains a copy) and a completed Order Cancellation Form. Returns where the sender cannot be identified or that are not accompanied by an Order Cancellation Form will be refused. After 14 calendar days, Marypup can no longer accept returns. Physical returns cannot be accepted under any circumstances.
The costs and risks associated with returns are borne by the Client, who is responsible for keeping any proof of return.
Purchases will be refunded within 14 calendar days of Marypup’s timely receipt of the returned items, provided all specified conditions have been strictly met. In no case can the refunded amount exceed what the Client actually paid. Refunds will be made using the same payment method used for the original order.

11. Legal Warranty and Claims Procedure
Marypup guarantees that the Products offered for sale are free of any visible or hidden defects that would render the Product unusable or unsafe.
This warranty does not affect the statutory rights of the client under their national legislation.
Clients must immediately contact customer service if they wish to invoke this warranty and must notify Marypup of the non-conformity in writing to customer service, in any case within two months of discovering the defect.

The warranty does not apply to products that have been intentionally or negligently damaged by the client.
It also does not apply if the damage is due to exposure to melted snow, transportation, or misuse.
Clients may contact customer service if they have questions about the warranty. If the Client has a claim, they may contact customer service by filling out the contact form.
12. Intellectual Property Rights
All parts of the website, including the technology used to create and maintain it, are the exclusive property of Marypup and are protected by copyright. Users who have their own website and wish to publish an automatic link between their site and Marypup’s homepage, even for personal use only, must seek Marypup’s explicit permission to do so.
All elements (hereinafter referred to as "Elements"), including texts, the database with all data published on the website, the layout and graphic design of the web pages, the sales catalog, photos, images, videos, and music on the site, are protected by copyright, database rights, trademark rights, patent rights, and all other forms of intellectual property rights worldwide. They therefore remain the exclusive property of Marypup and cannot be copied, published, imitated, or used in any form without Marypup's prior written consent. This consent must be obtained in writing, except where Marypup itself has allowed certain elements to be shared via social media, in which case the consent is limited to the specific elements and the social networks for which Marypup has permitted sharing.
13. Liability
Marypup cannot be held liable in any way for direct or indirect losses (such as loss of use, profit, opportunity, etc.) resulting from the use or unavailability of the Site.
Marypup is not responsible for any damage to the Client’s systems resulting from visiting the Site, including hacking or computer viruses.
Marypup is not liable for any errors that may appear in the photographs or text used in the product descriptions on the Site.
Marypup cannot be held liable for undelivered orders due to stock shortages or circumstances beyond its control, including force majeure events, disruptions, or suspension of transportation, postal, or communication services, floods, fires, accidents, or damages inherent to the use of the network.
In all cases where Marypup is or could be held liable, Marypup's responsibility will be limited to the amount the Client has actually paid for the order in question.
You expressly agree that your use or inability to use the service is at your own risk. The service and all products and services provided to you through the service are (unless expressly indicated otherwise by us) provided "as is" and "as available" for your use, without any representation, warranty, or condition of any kind, whether express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
14. Disputes and Governing Law
In the event of a dispute between the parties regarding the agreement, the courts of the judicial district of Brussels shall have exclusive jurisdiction over the matter.
The agreement between the parties is governed by Belgian law.

You may view the latest version of the Terms of Use at any time on this page.
Marypup may modify these general terms and conditions at any time, including to comply with its legal obligations. Changes posted via the Site will apply to all future offers and orders.
Marypup reserves the right to change the design and content of its website at any time.
If a court decision should render any of the articles or paragraphs of these General Terms and Conditions null or unenforceable, this will not affect the validity or enforceability of the other articles and paragraphs of these General Terms and Conditions or the agreement between the parties.
